Introduction

We at Sacred Activations, LLC. (collectively, “Sacred Activations,” “we,” “us,” or “our”) have created this privacy policy to inform you of our policies regarding how we collect, use, disclose, share, and process information that we obtain about you through our information collection and use practices (i) websites owned and operated by Sacred Activations, LLC. including but not limited to tamraoviatt.com, forums.tamraoviatt.com, and directory.tamraoviatt.com (collectively, the “Websites”); (ii) our offerings and services that collect personal data (the “Services”). 


This Privacy Statement describes the privacy practices of Sacred Activations only and does not cover the practices of other companies, including those that may advertise or sponsor our content, products or services on any digital services. 

 

Sacred Activations is committed to protecting your privacy in a number of ways including using industry accepted security measures to protect against loss, misuse and alteration of data in our systems. This statement is designed to describe how we secure and maintain your personal data when you visit our Websites or when your personal data is collected during your use of the Websites. Rest assured, your personal data will never be sold, rented, traded, shared or leased other than as outlined in this Privacy Statement.

 

For the purposes of the EU’s General Data Protection Regulation 2016 (the “GDPR”) the data controller is Sacred Activations, LLC. Please see Section 9 below for additional disclosures applicable only to users based on the European Union (the “EU”).

 

Acceptance of Terms

Please note that by using or accessing our Websites and Services , you are agreeing to the terms of this Privacy Policy. By providing us information offline, you are also agreeing to the terms of this Privacy Policy. 

SECTION 1 – INFORMATION COLLECTION AND USE


When you use or access our Websites and Services, we may collect several different types of information for the purpose of providing and improving our services to you. 

Information we collect


PERSONAL INFORMATION

When you use or access our Websites and Services, we may ask you to provide us with certain personal data that we can use to contact or identify you. All information we collect and/or receive under this section is collectively called “Personal Information”. Personal Information may include, but is not limited to:

  • Email Address

  • First name and last name

  • Phone number

  • Address, State, Province, ZIP/Postal Code, City

You may be asked for this information at various times when interacting with our Websites and Services. With your permission, we may use your Personal Data to contact you with emails regarding our products, event updates, promotional materials, and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by contacting at support@sacredactivations.com.


OTHER INFORMATION: USAGE DATA

When you access and use our Websites, we may also collect information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Websites that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. 


ORDER INFORMATION

When you make a purchase from our shop in tamraoviatt.com, you must provide us with certain information about the products and services you are seeking to purchase. Such information is collectively called the “Order Information.”

BILLING INFORMATION

When you wish to purchase a product or service, you will be required to provide certain information in addition to the Personal Information and Order Information noted above. Such information may include a debit card number, credit card number, expiration date, billing address, activation codes, and similar information. Such information is collectively called the “Billing Information.” Although we will have access to the Billing Information, it will also be collected and processed by our third-party payment vendors pursuant to the terms and conditions of their privacy policies and terms of use.

 
INFORMATION FROM COOKIES AND SIMILAR TECHNOLOGIES
We use cookies to track the activity on our Websites and hold certain information.
 
Cookies are small packets of data that a website stores on your computer’s or mobile device’s hard drive so that your computer will “remember” information about your visit. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) to help us collect information and to enhance your experience using our Websites.

(i) _session_id – unique token, sessional, allows us to store information about your session (referrer, landing page, etc).

(ii) cart – unique token, persistent for 2 weeks, stores information about the contents of your cart.

(iii) _secure_session_id – unique token, sessional


INFORMATION FROM OTHER SOURCES
We also may collect or receive information from third parties, such as Facebook and/or other third-party social media sites.

How we use and share information

Our primary purpose in collecting information about you in connection with your use of our Websites and Services is to provide you or connect you with our products, services, and offerings that match your interests and preferences. However, we may use such information collected about you for a variety of purposes. Without limitation, we may use such information to:

  • Operate and improve our Websites and Services;

  • inform you with our services, products, special offers, event updates which you may find interesting, provided you have not opted out of receiving such information or, where required, we have your express consent;

  • enable your participation in our events;

  • provide Customer Assistance or Technical Support;

  • inform you of changes made to our Websites and Services

  • enforce our policies and terms of service, and investigate potential violations of such policies or terms;

  • general information about our products, services, and events; 

  • fulfill an order that you place through our website tamraoviatt.com, including to process payment for any purchase made;

  • Conduct promotional campaigns, or other marketing and commercial activities.

We may also use information about you that we collect in connection with your use of our Websites and Services for security, administrative, and legal purposes.

How do we get your consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.


How do we withdraw your consent?

If you change your mind after you opt-in, you may withdraw your consent for the continued collection, use, or disclosure of your information, at any time, by contacting us at support@sacredactivations.com.


SECTION 3 – RETENTION OF DATA

We will store your personal data for no longer than is necessary for the purpose for which such personal data is processed. Please note, however, that we may retain and use your personal data as necessary to comply with our legal obligations, to resolve disputes, and to enforce our agreements and rights, or if it is not technically and reasonably feasible to remove such information from our databases, which means that we may retain and use your personal data as necessary after you stop using our Websites and Services. Subject to the foregoing, we will endeavor to delete your personal data promptly upon your request.


SECTION 4 – DISCLOSURE OF DATA

We may disclose your personal information in the following situations:


Law Enforcement

Under certain circumstances, Sacred Activations may be required to disclose your Personal Information if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).


Legal Requirements

Sacred Activations may disclose your Personal Information in the good faith belief that such action is necessary to:

  • To comply with a legal obligation

  • To protect and defend the rights or property of Tamra Oviatt

  • To prevent or investigate possible wrongdoing in connection with the Websites and Services 

  • To protect the personal safety of users of the Websites and Services

  • To protect against legal liability 

Third Party Service Providers

We may disclose your personal data to third-party service providers who perform services on our behalf including third parties that process payments; send marketing communications on our behalf; help us create or maintain our databases or help us research or analyze use of our Websites. 

Unless you consent, we do not permit our service providers to use such information in order to market their own products or services to you directly. When we transfer any of your personally identifiable information to such a service provider or partner, that entity will be contractually required, among other things, (a) to use such information only to carry out those services that we have requested, (b) to abide by this Privacy Policy, and (c) to provide adequate protection for such information (as required by applicable legal requirements).


General Public

We may share with the general public via any of our platforms, including but not limited to our websites, social media, and emails, any information that you post as a user of our Websites and Services, such as information in an online review, live webinar, comment, forum, or blog posting. This may include information that identifies you (by username or otherwise). 


SECTION 5 – TRANSFER OF DATA

It is important to note that our Websites and their servers are operated in the United States. If you are located outside of the United States, please be aware that any Information you provide to us will be transferred to the United States. By using the Websites and by providing us Information when using our Services, you hereby irrevocably consent to this transfer and our use of the Information and data provided by you in accordance with this Privacy Policy.

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

Your data is stored through isolated data storage, databases, and the general WordPress application. We store your data on a secure server behind a firewall.


SECTION 6 – POLICIES OF LINKED WEBSITES AND THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our Websites or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

Our Websites may contain links to other websites that are not covered by this Privacy Policy and where information practices may be different from ours. Our provision of a link to any other website or location is for your convenience and does not signify our endorsement of such other website or location or its contents. 

When you click on such a link, you will leave our Websites and go to another website. During this process, another entity may collect information from you. We have no control over, do not review, and are not responsible for the privacy practices or the content of such other websites. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of data after you click on links to such outside websites. We encourage you to read their privacy statements.


Payment

If you choose a direct payment gateway to complete your purchase, then our payment processors, Paypal or Authorize.net, store your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as it’s necessary to complete your purchase transaction. After that is completed, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express, and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 7 – DATA SECURITY

To protect your personal information, we take reasonable precautions and we have implemented technical and procedural measures to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with AES-256 encryption.

Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the Information that you supply will not be intercepted while being transmitted to and from us over the Internet.

Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally-accepted data security standards.

You also play a role in protecting your personal information. Please do not share your user name or password with others.


SECTION 8 – AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.


Children’s Privacy

We do not knowingly collect Personal Information from anyone under the age of 18. If you are a parent or a guardian and you are aware that your child has provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from children without verification of parietal consent, we take steps to remove that information from our servers. 


SECTION 9 — ADDITIONAL DISCLOSURES FOR USERS BASED IN THE EUROPEAN UNION

General
We are headquartered in the United States. By using our Websites and Services from outside the United States, you acknowledge that your personal data may be accessed by us or transferred to us in the United States and to our affiliates, partners, and service providers who are located around the world; and that your personal data will be transferred to, and stored and processed in, the United States or elsewhere in the world where our servers are located.

If you are based in the EU, we will only process your personal data for a purpose described in this Privacy Policy if (1) you have provided your consent (which can be withdrawn at any time), (2) the processing is necessary for the performance of a contract we are about to enter into or have entered into with you, (3) we are required by law, (4) processing is required to protect your vital interests or those of another person, or (5) the processing is necessary for the purposes of our legitimate commercial interests (except where such interests are overridden by your rights and interests).

Rights Under the GDPR
If you are based in the EU, in certain circumstances you have rights under data protection laws in relation to your personal data that we hold about you – specifically:

You may have the right to request access to any personal data we hold about you as well as related information, including the purposes for processing the personal data, the recipients or categories of recipients with whom the personal data has been shared, where possible, the period for which the personal data will be stored, the source of the personal data, and the existence of any automated decision making.

  2. Request correction of your personal data. You may have the right to obtain without undue delay the rectification of any inaccurate personal data we hold about you.

  3. Request erasure of your personal data. You may have the right to request that personal data held about you be deleted.

  4. Request restriction of processing your personal data. You may have the right to prevent or restrict processing of your personal data.

  5. Request transfer of your personal data. You may have the right to request transfer of your personal data directly to a third party where this is technically feasible.

Also, where you believe that we have not complied with our obligation under this Privacy Policy or European data protection law, you have the right to make a complaint to an EU Data Protection Authority.

SECTION 10 – CHANGES IN THIS PRIVACY POLICY

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We reserve the right to modify this privacy policy at any time, so please refer back to this Privacy Policy on a regular basis. Changes and clarifications will take effect immediately upon their posting on the website. By accessing the Websites and/or using our services after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. 

If we make material changes in this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
